I think you know that that's not a reasonable analogy. There is no federal law protecting the confidentiality of university or NIL collective payments to athletes. The most analogous case is State ex rel. Toledo Blade v. University of Toledo Foundation. This was a 7-0 unanimous decision of the Ohio Supreme Court. NIL Collectives in this regard are very much like university foundations in that their sole reason for existence is to the support the university with which they are affiliated. If a NIL collective associated with a state university in Ohio tries to claim some sort of independence that shields them from FOIA requests as did the UT Foundation, I predict they will be greeted with the same rebuff by the Ohio Supreme Court, if the case gets that far, as did the UT Foundation.
